1. In your opinion, does the speech in question in Rankin constitute a matter of public concern? The dissent in the case (see excerpt below), articulated by Chief Justice Rehnquist, argued that the speech in question was not a comment on President Reagan’s policy and, thus, was not a matter of public concern. Do you agree or disagree with the majority opinion in the case? 

2. Suppose the employee’s comments regarding President Reagan had sowed discord and disharmony in the workplace. Had the defendant been able to demonstrate this, would the ruling have changed based on the Supreme Court’s legal framework for freedom of expression cases? 

3. What if the employee in question had been attached to the president’s local security detail in Washington, D.C., during the time of the assassination attempt. Might this have affected the opinion of the Court?
